Family Medical Leave
FMLA is federally mandated time off for a serious medical condition. Check the eligibility requirements below to see if you qualify. Misuse of FMLA can lead to attendance issues and in serious cases of misuse, termination. You must ensure all the required documentation is completed in a timely manner and only use FMLA in connection with the medical condition it was approved for. Eligibility Requirements (must have all):
(a) Employed for at least 12 months
Must be an employee of the carrier for 12 months
(b) At least 1,250 hours of service during the 12-month period immediately preceding the start of the leave.
The total hours of service are determined by counting the "actual hours worked" by an employee. This includes all the time an employee is required to be on the Carrier's premises, on duty or at a prescribed work place, or time spent in Military Service. The hours of service are determined by the number of hours worked in the 365 days prior to opening a case.
To check your hours worked, go to CMTS and click on "attendance." This will show you your on duty time for each month during the previous year.
(c) Must be for a qualifying reason
(d) The case is for self or a qualifying family member. Qualifying family members include:
Spouse
Child - a biological, adopted, or foster child, a stepchild, a legal ward, or a child of a person standing in loco parentis, who is either under age 18, or age 18 or older and “incapable of self-care because of a mental or physical disability” at the time that FMLA leave is to commence.
Parent - a biological, adoptive, step or foster father or mother. This does not include "in-law" parents
Loco Parentis- Person standing in place of a parent – will need to submit supporting documentation for loco parentis relationship with FMLA application.
Applying for FMLA on MyUP
From the MyUP Page:
Open the menu on the left-hand side of the page.
Select employee.
Select ehealthsafe.
On the menu on the left-hand side, select "My FMLA"
Follow and complete the prompts regarding the medical condition necessitating FMLA.
After this online form is completed, you MUST get the medical documents to the medical professional caring for the medical condition. You have 14 days for them to fill out the forms and fax them back to UP. The barcode page that was printed must be included so the paperwork can be matched with the online request.
Although FMLA is available for use as soon as the online portion is completed, it is not recommended that it be used to layoff until it has been fully approved. FMLA layoffs can be converted to an unapproved layoff status, if the request is denied.
