Improperly Forced to Yard
The Claim:
When forced from a road to a yard assignment due to being junior Remote Control Qualified, while junior non-qualified employees are allowed to work on the road.

REQUIRED DOCUMENTATION:
A copy of the seniority roster
Job histories demonstrating an equivalent number of junior employees being allowed to work road assignments, as would allow you to hold the road otherwise.
Bid history showing date of bid to leave yard service.
REQUIRED CLAIM LANGUAGE:
Claiming lost road wages from (date to date) from the (circ and job ID) in addition to all other yard earnings due to improper restriction of seniority. On (date) I was forced to the circ-7 job id yard assignment from the (circ-) (job id) road assignment. Senior employees, (forced employee name ) , and (forced employee name) were also forced to the (circ-7) yard. Junior employees ( name 1) (name 2) and (name 3) have been allowed to remain on road assignments. Per Section 3 of the 2002 National Remote Control Agreement, "all employees are to be RCL qualified".
