Unable to Exercise Seniority
The Claim:
When force assigned to an assignment without being given 48 hours to exercise your seniority.
YOU MUST MAINTAIN BIDS TO RETURN TO THE PREVIOUS CLASS OF SERVICE AT YOUR FIRST OPPORTUNITY.
Claim everyday until you are awarded a bid to a more desired assignment or you are displaced and given your displacement rights (bump board).
REQUIRED DOCUMENTATION:
A copy of the seniority roster.
Work history showing forced to new assignment.
Bid history showing date of bid to return to previous class of service, previous board, or preferred board you can hold.
REQUIRED CLAIM LANGUAGE:
Claiming lost wages from __/__/__ to __/__/__ from the __circ-7__ and __job ID__ in addition to all other earnings due to improper restriction of seniority and not being permitted to exercise my displacement rights per Article XII of the 1996 National Agreement. On __/__/__ I was notified that I was being forced from the __(circ-7)__ __(board)__ to the __(circ-7)__ __(board)__ while junior employee _____________ was permitted to remain in that class of service. I should have been displaced from the __(circ-7)__ __(board)__, moved to the applicable bump board, and given the opportunity to exercise my displacement right within forty-eight (48) hours.
****NOTE: if no junior employee was permitted to remain in that class of service (e.g. you were the junior employee on XC05 and forced to the RT05 while able to hold the RT56), omit "while junior employee _____________ was permitted to remain in that class of service" from your claim.****
